KMKSC shareholder and practice leader Alexander "Sandie" Pendleton is a widely known authority on release-of-liability and recreational-injury issues both nationally and in Wisconsin. Diverse organizations such as motorcycle manufacturers, snowmobile manufacturers, skydiving schools and paintball combat facilities have utilized his knowledge and experience for the creation of release agreements. He has prepared liability-limitation strategies and forms for sports venues such as NBA arenas, MLB stadiums and Olympic-training facilities. He has prepared agreements for large-scale multi-sport athletic events (e.g., the Badger State Games), triathlons, marathons, bike races and snowmobile events. His experience includes designing both traditional paper forms, and electronic forms (Internet-based and/or electronic-kiosk), and developing record-management policies relating to such.
Unlike many attorneys (and others) who advise companies involved in providing recreational opportunities, Sandie has extensive litigation and courtroom experience. Sandie has represented organizations in court proceedings (including those engaged in high-risk recreational events) that wish to rely upon waiver agreements, and has successfully defended clients in wrongful death recreational-activity cases. Sandie is the author of numerous articles relating to such issues (both for attorneys and industry audiences), and is a regular speaker at continuing legal education events (including events sponsored by the American Bar Association), and has provided presentations on waivers of liability to numerous insurance organizations, state bar associations, plaintiffs bar organizations and defense bar organizations.
